Abuse Law 104/1992.
The law nr. 104/1992, provides for concessions for some categories of employees.

In particular, the law allows these workers, who have a disabled family member, to take advantage of hours and / or days of leave for assistance.

These are hours / days of work - spent to assist the disabled family member - regularly paid.

A sentence of the Cassation provides for the immediate dismissal of the employee who uses these permits for personal purposes.

Given the above, the entrepreneur has the right to have a private investigation carried out by an authorized investigative institute, having only the suspicion that his worker is taking advantage of the permits - granted by Law 104 - for personal purposes.

This investigative institute collects the evidence of the investigation in a file (Investigation report), which it completes with the relative supports. This Report (and supports) may be used by the client before the competent Authority. In addition, the investigating agents who carried out the related investigation may be called upon to confirm what is stated in the Investigation Report, as witnesses.
